UCATT Steps Up Campaign For Fountains Workers

UCATT have stepped up their campaign in support of 150 workers who were employed by Fountains on Norwich City Council contracts.

The workers, who were employed on various contracts including street cleaning, parks maintenance and grave digging, were dismissed on Monday 23rd January following the sale of Fountains (formerly part of Connaught) to OCS.

UCATT have written to Laura McGillivray the Chief Executive of Norwich City Council, seeking assurances that when new contractors are appointed to take over Fountains’ contracts that the workforce is protected and they are TUPE transferred to the new contractor.

UCATT are quoting the Court of Appeal decision Key 2 Law v Secretary of State, which 0demonstrates that TUPE regulations still apply even if the original company had entered administration.

Brian Rye, UCATT's Eastern Regional Secretary, said: "The Council has a moral responsibility for these workers. They were employed on council contracts. The council needs to give firm assurances that all new contractors will rehire the workforce on their existing terms and conditions."
