British Business Boosted By Overhauled Patent Rules

A major overhaul of rules governing the UK patent system is set to make life a lot easier for British businesses.

The new legislation, which comes into force today modernises and updates longstanding patent rules to offer customers a flexible system that allows for the greater use of e-business services.

Firms in disputes will find litigation at the UK-IPO much easier with more opportunities for alternative dispute resolution.

Introducing the new rules, Lord Triesman, Minister for Innovation, stated: "We are aiming to make life easier and fairer for the British business community so that they can get on with what they do best, leading the world in innovation and enterprise."

As long ago as 2005 it was recognized that an overhaul of the rules was needed and significant planning has gone into the new-look legislation.

From December 17 there will be clear and simple new rules on litigation setting out flexible and user-friendly procedures with clearer case-management powers and simplified and updated administrative requirements for patent applications.

There will be modernised drafting to reflect electronic filing of patent applications and internet availability of patent documents, clear and consistent legislation on supplementary protection certificates and a special implementation of procedures under the recent EC legislation covering paediatric medicines and compulsory licenses.

Chief Executive of the Intellectual Property Office, Ian Fletcher, added: "I'm pleased to have in place a new set of Patent rules which lift the burden from UK business and better allow the UK-IPO to expand the range of electronic services we offer customers".

The new legislation also makes provision for the Welsh language in allowing patent applications to be filed in English or Welsh.
