Owner Of Historic Hull Property Prosecuted

A national property company has recently been prosecuted by Hull City Council for failing to comply with an enforcement notice relating to a well-known Hull property.

At a hearing at Hull and Holderness Magistrates' Court, Queensway Properties Ltd pleaded guilty to the offence of failing to comply with the Enforcement Notice. The court fined the company £600 and ordered it to pay Hull City Council £400 costs bringing the total to £1,000.

The council served the Enforcement Notice under the Town and Country Planning Act 1990 to Queensway Properties as owners of the former Oberon public house on Queen Street in Hull on 7 March 2008.

The notice required the company to remove a large unauthorised UPVC window and replace it with one in keeping with the previous design and proportions. Queensway Properties had failed to act as instructed which left the council's planning enforcement section with no other option than to proceed with a prosecution.

Councillor John Fareham, Chairman of the Planning Committee, said: "This case and decision demonstrates the importance of early engagement with developers to ensure high standards of design.

"However, on occasions where the developer proceeds at risk against the advice of the planning authority the fallout can be considerable in terms of a fine and corrective work.

"The council's planning service offers the opportunity for people to talk about their proposals with the choice of a service from the planners or at certain levels the committee; we embrace working with people."
